BUILD LEARNING HUB PRIVACY POLICY

This BUILD Learning Hub Privacy Policy (“Privacy Policy”) explains how Businesses United in Investing, Lending and Development, a California [and 501(c)(3)] nonprofit organization (“BUILD” or “we”) collects, uses, discloses, and secures personal information when we provide our services to you through our online learning management platform (https://learninghub.build.org/) (the “Platform”). The Platform is intended for students, teachers and educators, and administrators to access our professional development resources, take assessments, and communicate with each other. As used in this Privacy Policy, “personal information” means information that relates to an identified or reasonably identifiable natural person.

Note that this Privacy Policy only applies to our online learning management platform and does not apply to other BUILD websites or applications. Our BUILD Privacy Policy can found here.

1. INFORMATION COLLECTION AND PROCESSING

We collect and process personal information to provide services through the Platform, and in order to provide, improve, and enhance the Platform and the services we offer.

Information You Provide to Us

Contact or support request submissions. When you contact us or request support, we collect the personal information you provide to evaluate and respond to your request. We may also use the information to improve our Platform or other aspects of our services and in the normal course of our operations. Also, we may use this information to send you email messages with program information, news, notifications, and other updates relevant to our services and the Platform. The information we collect may include your name, email address, and telephone number, and the content of any messages or submissions.

Accounts and Registration. You must register for an account to use the Platform and when you do, we will collect the personal information you provide, including your username, password, and email address. We also collect the personal information you provide to customize your profile, including your name, profile photo, and class information.

Information We Collect When You Use the Platform

Assessment Performance. We collect your scores and other performance information when you take assessments, tests, and other performance-measurement tools through the Platform. We collect this information in order to provide you with our services and improve our Platform.

Messaging on the Platform. The Platform allows users to send messages to each other. When you use this aspect of the Platform, we collect the content of your messages and any files or materials you upload or attach to such messages. We use this information in order to provide the Platform and our services. Your communications should not contain any sensitive information and you should not upload any documents or materials to the Platform that contain sensitive information.

Automated Data Collection; Cookies and Similar Technologies. When you use our Platform, we and our third-party partners, such as website hosting providers, to collect information by automated means.

We may use cookies and similar technologies to collect your IP address, information about your device (such as your browser characteristics, device IDs and characteristics, and operating system version) and information concerning your usage of our Platform (including the link you used to reach a given webpage). We use this information to determine how many users visited particular webpages, viewed particular content, or opened messages or alerts, and we may also use such information to improve the performance of the Platform, to improve our services, and to enforce our service terms and prevent malicious conduct.

You may be able to change a web browser’s settings to block and delete cookies when you access the Platform through the web browser. However, if you do that, the Platform may not work properly; also, we will still receive basic information (such as last URL visited) when you navigate to the Platform. Note that the Platform does not respond to browser do-not-track signals.

2. DISCLOSING INFORMATION

We may share any of the categories of personal information listed above for our operations and services as described below.

Schools and educational institutions. For teachers and administrators that use our Platform, we may share personal information with your school or educational institution. We do so for our operational purposes, such as to ensure you have access to the correct materials and content, to communicate with you, and to promote and provide our Platform and services.

Teachers, administrators, schools, educational institutions, parents, or legal guardians. For students that use our Platform, we may share personal information with your teacher(s), administrator(s), school, educational institution, parent, and/or legal guardian. We do so for our

operational purposes, such as to ensure you have access to the correct materials and content, to track your performance on assessments, to communicate with you, and to promote and provide our Platform and services.

Vendors and service providers. We share personal information with vendors and service providers that process such information to perform services for us in connection with the Platform and our other operations, including operating and securing the Platform.

Legal and similar disclosures. We may share personal information with law enforcement, the courts, our advisors, attorneys, and others who participate in legal processes or proceedings, if we believe doing so is required or appropriate to: comply with legal requirements and law enforcement requests (such as a court order or subpoena), comply with legal process (such as discovery), or protect your, our, or others’ rights, property, or safety.

Merger, sale, or other asset transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal information may be shared with the other parties and advisors involved under an obligation of confidentiality in connection with the negotiation of such transaction, and your personal information may be transferred as part of such a transaction (subject to compliance with applicable laws).

3. INFORMATION SECURITY

We endeavor to process your information securely, in accordance with this Privacy Policy, and in accordance with information security requirements imposed by applicable law. Note, however, that certain aspects of Internet communications are inherently not completely secure.

4. LINKS TO UNAFFILIATED THIRD-PARTY WEBSITES

The Platform may contain links to unaffiliated third-party websites. This Privacy Policy does not apply to the practices of such other websites, and we are not responsible for the actions and privacy policies of the third parties that operate or interact with those websites.

5. CHILDREN’S INFORMATION

We take children’s privacy seriously. All students who use the Platform will be invited by a teacher or administrator. When the teacher or administrator invites their students to the Platform, we rely on consent obtained from the teacher or administrator or the school/educational institution acting as an agent of the student user’s parent or legal guardian in order to process the student user’s personal information.

A parent or legal guardian of a student may contact us using the methods set forth below to request that we delete the information from our records or otherwise cease the use of that student’s information.

7. POSTING OF A REVISED BUILD LEARNING HUB PRIVACY POLICY

We may make changes to this Privacy Policy from time to time, and the revised version will be effective when it is posted and will apply to personal information received after that date. If we make any material changes, we will provide notice of such changes on the Platform or in any other pertinent location where this Privacy Policy may be posted for a reasonable period of time (which we estimate will be approximately two weeks). We encourage you to review this Privacy Policy periodically, especially if you do not visit the Platform regularly.
